OFFICIAL RULES 

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. Subject to all applicable federal, state, and local laws and regulations. 

BY ENTERING THIS SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR FROM YOU, A CLASS-ACTION WAIVER, AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.   

SPLAT “WIN YOUR FAV REDS” SWEEPSTAKES (“Sweepstakes”) starts 12:01 PM Pacific Time on February 10, 2026 and ends at 11:59 PM Pacific Time on February 13, 2026. 

1. Sponsor/Administrator:  Developlus, Inc., 1575 Magnolia Avenue, Corona, CA 92879 is the sponsor and administrator (the “Sponsor”) of the Sweepstakes. 

2. ELIGIBILITY: SUBJECT TO THE ELIGIBILITY REQUIREMENTS FOR THE PRIZE (AS DETAILED BELOW).  THE SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO ARE AT LEAST EIGHTEEN (18) YEARS OLD AND THE AGE OF MAJORITY IN THEIR STATE OF RESIDENCE AT THE TIME OF ENTRY. 

Employees, officers, directors, agents and representatives of Sponsor and Instagram, Inc. (“Instagram”) and all of their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, franchisees, licensees, distributors, prize providers, advertising, promotion and public relations agencies and their respective officers, directors, employees, agents, independent contractors, representatives and agencies (collectively, the "Sweepstakes Entities") and those living in the household of same whether related or not are not eligible to participate in the Sweepstakes and/or win the Prizes (as defined below). 

3. HOW TO ENTER THE SWEEPSTAKES: A valid public Instagram account and internet access are required to enter this Sweepstakes. Becoming a registered Instagram user and entry into the Sweepstakes is free but is subject to acceptance of the terms and conditions of use of www.instagram.com. To become a registered Instagram user, visit www.instagram.com and follow the instructions to become a user. 

Sweepstakes begins on February 10, 2026 at 12:01 PM Pacific Time and ends on February 13, 2026 at 11:59 PM Pacific Time (“Sweepstakes Period”).  Sponsor’s clock shall be the official timekeeper for the Sweepstakes. 

During the Sweepstakes Period, Sponsor will post a Sweepstakes announcement on Sponsor’s official Instagram account @splathaircolor on Instagram (“Post”). 

To enter the Sweepstakes: (a) Follow @splathaircolor and (b) Like the Post; and (c) Comment on the Post with the two red shades you want to win and the hashtag #splatsweepstakes. 

For one (1) additional bonus entry, tag a friend’s Instagram account in your comment to the Post.   Tags of brands, celebrities/public figures, giveaway/contest, bot, fake, inactive, or spam accounts (as determined by Sponsor in its sole discretion) will not qualify and may result in disqualification.  Maximum of one (1) additional bonus entry during the Sweepstakes Period.  Entries that meet the requirements included in these Official Rules are referred to herein as "Eligible Entries." 

Instagram account must be public to enter and entrant must remain a follower of @splathaircolor on Instagram for the duration of the Sweepstakes Period and as of the Drawing Date to remain eligible. 
 

LIMIT ONE (1) ENTRY PER PERSON AND UP TO ONE (1) ADDITIONAL BONUS ENTRY PER PERSON, AND PER INSTAGRAM ACCOUNT. ANY ATTEMPTED ENTRIES FROM ANY PERSON OR INSTAGRAM ACCOUNT IN EXCESS OF THE LIMIT STATED SHALL BE DEEMED VOID. ALL ELIGIBLE ENTRIES RECEIVED WILL BE ELIGIBLE FOR THE SWEEPSTAKES. 
 

Use of automated entries or programs or entries submitted by third parties is prohibited and will be disqualified. Any attempt by any entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that entrant’s entries and that entrant may be disqualified at Sponsor’s discretion. Multiple entrants are not permitted to share the same Instagram account. Normal Internet, phone and usage charges imposed by entrant’s online, or phone service may apply and are entrant’s responsibility. In the event of a dispute as to the identity of an entrant, the authorized account holder of the Instagram account used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person who is assigned the Instagram account by Instagram. Potential winners may be required to show proof of being the authorized account holder. 

4. PRIZES:  Five (5) winners will be selected to win a prize (“Prize”).  The Prize shall consist of the winner’s choice of two (2) red hair color kits from the following list: 

• ColorShine Red Velvet  
• Luscious Raspberries  
• Midnight Ruby  
• Scarlet  
• Whipped Cherry  
• Crimson Obsession  

Approximate retail value (“ARV”) of each prize: $40  

Total ARV of all prizes to be awarded: $200 

Prizes are non-assignable and nontransferable, and may not be given, bartered, sold, or exchanged for cash or another prize.  Prizes may not be upgraded, and no substitutions by winner will be allowed; except Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason.  Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded.  Winners may waive their right to receive prizes. 

Prizes cannot be substituted, exchanged, assigned, transferred or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion.  Sponsor will not replace any lost or stolen prizes.  Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes.   

5. WINNER SELECTION AND NOTIFICATION: Five (5) winners will be selected in a random drawing on February 14, 2026 (“Drawing Date”) from among all Eligible Entries received by Sponsor during the Sweepstakes Period. Odds of winning will depend on the total number of eligible entries received throughout the Sweepstakes Period. The winners will be announced on February 14, 2026 on Instagram via @splathaircolor.  Winners will be notified by Instagram direct message on February 14, 2026. If, within forty-eight (48) hours of the first attempt to contact a potential winner, that potential winner is not available, unable to be contacted, or does not respond to the attempts to contact them, or if the potential winner fails to comply with these Official Rules, that potential winner will be deemed to have forfeited the Prize, and Sponsor may at its sole discretion award the Prize to an alternate potential winner selected from all Eligible Entries received.  Alternate potential winners must satisfy all eligibility requirements. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

6. GENERAL CONDITIONS: Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. 

Sponsor reserves the right, in its sole discretion, to modify, suspend, extend, or cancel the Sweepstakes (or any portion thereof) in the event Sponsor is prevented from executing the Sweepstakes as contemplated herein by any event beyond Sponsor’s control, including but not limited to fire, flood, earthquake, explosion, pandemic, public health epidemic or crisis, labor dispute or strike, act of God or public enemy, network or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), court order, or federal, state, or local government law, order, or regulation (each, a “Force Majeure Event”). Sponsor also reserves the right, in its sole discretion, to modify, suspend, extend, or cancel the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes or events corrupt administration, security, fairness, integrity, or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify the winner and award the prize by way of random drawing from among all non-suspect, eligible entries received up to the time of cancellation. Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. 

If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, Sponsor, at its discretion, may elect to select another winner and hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.   

The Sweepstakes Entities and any and all Internet server(s) and access provider(s) (collectively, “Releasees”) are not responsible for any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes; inability to access Instagram, or any web pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including Instagram) or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof.  All entries become the property of Sponsor and will not be acknowledged or returned.  False, fraudulent or deceptive entries or acts shall render entrants ineligible.  By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules. 

7. PRIVACY INFORMATION:  By entering the Sweepstakes, you agree to Sponsor’s use of your personal information, as described in the Sponsor’s Online Privacy Policy (Link: https://splathaircolor.com/pages/privacy-policy). 

8. Release and Limitations of Liability:  By participating in this Sweepstakes, entrants agree that the Sweepstakes Entities are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries.  No more than the stated number of prizes will be awarded. 

BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT THE SWEEPSTAKES ENTITIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND ENTRANTS AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS SWEEPSTAKES ENTITIES AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY.     

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.  CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. 

9. PUBLICITY:  EXCEPT WHERE PROHIBITED BY LAW, WINNERS GRANT TO THE SPONSOR, ADMINISTRATOR, AND ALL OF THEIR RESPECTIVE PARTNERS, PARENT COMPANIES, DIVISIONS, SUBSIDIARIES, AFFILIATES, TRUSTEES, FRANCHISEES, LICENSEES, DISTRIBUTORS, PRIZE PROVIDERS, ADVERTISING, PROMOTION AND PUBLIC RELATIONS AGENCIES (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR) AND THOSE ACTING PURSUANT TO SPONSOR AND ADMINISTRATOR’S AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, EACH WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.  ENTRANTS AGREE THAT SPONSOR SHALL OWN THE ENTRIES, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED, AND THAT SPONSOR AND ITS DESIGNEES SHALL HAVE THE PERPETUAL, WORLDWIDE RIGHT TO EDIT, PUBLISH, AND USE THE ENTRIES IN ANY WAY AND IN ANY MEDIA FOR TRADE, ADVERTISING, PROMOTIONAL, AND/OR OTHER PURPOSES AS SPONSOR AND/OR ITS DESIGNEES MAY DETERMINE WITHOUT FURTHER CONSIDERATION TO ENTRANTS OR ANY THIRD PARTY.   

10. DISPUTES/CHOICE OF LAW:  Except where prohibited, each entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Riverside County, California; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (c) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (d) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased This content is governed by the laws of the State of California in the United States of America, without respect to conflict of law doctrines.

12. NO ENDORSEMENT: This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram. 

Developlus, Inc., Instagram, or any affiliated and/or associated parties shall not be liable for technical, pictorial, typographical or editorial errors or omissions contained herein. All trademarks or logos used herein are trademarks of their respective owners in the United States and/or other countries.  All rights reserved.
