BY ENTERING THIS SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. `SPONSOR FROM YOU, A CLASS-ACTION WAIVER, AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.

 

“THE SPLAT BEETLEJUICE BEETLEJUICE AFTER LIFE EXPERIENCE VIP PACKAGE SWEEPSTAKES” (the “Sweepstakes”) starts at 12:01am Pacific Standard Time (“PST”) on September 6, 2024 and ends at 11:Pacific Standard Time (“PST”) on September 15, 2024 (the “Sweepstakes Period”). The Sweepstakes is open only to legal residents of the United States who reside in the Greater Los Angeles area who are at least eighteen (18) years old at the time of entry. Subject to all applicable federal, state, and local laws and regulations.

 

Sponsor/Administrator:  Developlus, Inc., 1575 Magnolia Avenue, Corona, CA 92879 is the sponsor (the “Sponsor”) of the Sweepstakes.

 

ELIGIBILITY: SUBJECT TO THE ELIGIBILITY REQUIREMENTS FOR THE PRIZE (AS DETAILED BELOW).  THE SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES WHO RESIDE IN THE GREATER LOS ANGELES AREA AND ARE AT LEAST EIGHTEEN (18) YEARS OLD AT THE TIME OF ENTRY.

 

Employees, officers, and directors of Sponsor, ADMINSTRATOR, WARNER BROS. ENTERTAINMENT INC. (“WARNER BROS.”), INSTAGRAM, INC. (“InsTAGRAM”) and all of their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, franchisees, licensees, distributors, prize providers, advertising, promotion and public relations agencies and their respective officers, directors, employees, agents, independent contractors, representatives and agencies (collectively, the "SWEEPSTAKES Entities") and those living in the household of same whether related or not are not eligible to participate in the SWEEPSTAKES and/or win the Prizes (as defined below).

LIMIT ONE (1) ENTRY PER PERSON, AND PER EMAIL ADDRESS OR SOCIAL MEDIA ACCOUNT.  ANY ATTEMPTED ENTIRIES FROM ANY PERSON OR EMAIL ADDRESS IN EXCESS OF THE LIMIT STATED SHALL BE DEEMED VOID. ALL ELIGIBLE ENTRIES RECEIVED WILL BE ELIGIBLE FOR THE SWEEPSTAKES.

Use of automated entries or programs or entries submitted by third parties is prohibited and will be disqualified.  Any attempt by any entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that entrant’s entries and that entrant may be disqualified at Sponsor’s discretion.  Multiple entrants are not permitted to share the same email address or social media account.  Normal Internet, phone and usage charges imposed by entrant’s online, or phone service may apply and are entrant’s responsibility.  In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant.  The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address.  Potential winners may be required to show proof of being the authorized account holder.  Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win.

 

WINNER SELECTION AND NOTIFICATION: Five (5) winners will be selected in a random drawing on September 16, 2024 from among all eligible entries received by Sponsor during the Sweepstakes Period. Odds of winning will depend on the total number of eligible entries received throughout the Sweepstakes Period. The winners will be notified by email within forty-eight (48) hours after the drawing period using the contact information provided at the time of entry in the Sweepstakes. If, within twenty-four (24) hours of the first attempt to contact a potential winner, that potential winner is not available, unable to be contacted, or does not respond to the attempts to contact him/her, or if the potential winners fails to comply with these Official Rules, that potential winner will be deemed to have forfeited the prize, and Sponsor may at its sole discretion award the prize to an alternate potential winner selected from all eligible entries received in the applicable drawing pool.  Alternate potential winners must satisfy all eligibility requirements. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

 

 

PRIZES: 

PRIZING: Five (5) winners will each receive two (2) VIP admission to the Beetlejuice Beetlejuice: The Afterlife Experience in Los Angeles, California (“Event”), one (1) special VIP package, and one (1) complimentary Digital Movie: Beetlejuice (1988). Each winner and their guest are solely responsible for all other expenses not specifically set forth herein, including, but not limited to, transportation to and from the Event.

 

Approximate retail value (“ARV”) of each prize: $112. 

 

 

 

By entering this Sweepstakes and accepting the prize, the prize winner agrees to maintain his or her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any prize-related activity. Each winner understands and agrees that Sponsor and the applicable prize providers have the right, in their sole discretion, to disqualify and remove such winner or his/her guest from the Event at any time if the winner’s or his/her guest’s behavior is at any point uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Sponsor, Warner Bros., or otherwise violates the policies of the prize providers.

 

 

Prizes are non-assignable and nontransferable, and may not be given, bartered, sold, or exchanged for cash or another prize.  Prize may not be upgraded, and no substitutions by winner will be allowed; except Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason.  Prizes not won and claimed by eligible winners in accordance with these terms and conditions will not be awarded.  Winners may waive their right to receive prizes.

 

Prizes cannot be substituted, assigned, transferred, or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its sole discretion.  Sponsor will not replace any lost or stolen prizes.  Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. 

 

General Conditions: Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.

 

Sponsor reserves the right, in its sole discretion, to modify, suspend, extend, or cancel the Sweepstakes (or any portion thereof) in the event Sponsor is prevented from executing the Sweepstakes as contemplated herein by any event beyond Sponsor’s control, including but not limited to fire, flood, earthquake, explosion, pandemic, public health epidemic or crisis, labor dispute or strike, act of God or public enemy, network or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), court order, or federal, state, or local government law, order, or regulation (each, a “Force Majeure Event”). Sponsor also reserves the right, in its sole discretion, to modify, suspend, extend, or cancel the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes or events corrupt administration, security, fairness, integrity, or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify the winner and award the prize by way of random drawing from among all non-suspect, eligible entries received up to the time of cancellation. Sponsor also reserves the right, in its sole discretion, to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

 

If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, Sponsor, at its discretion, may elect to select another winner and hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.  The database clock of the Entry Site will be the official timekeeper for the Sweepstakes.

 

The Sweepstakes  Entities and any and all Internet server(s) and access provider(s) (collectively, “Releasees”) are not responsible for any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes; inability to access the Entry Site, or any web pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including the Entry Site)-  or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof.  All entries become the property of Sponsor and will not be acknowledged or returned.  False, fraudulent or deceptive entries or acts shall render entrants ineligible.  By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules.

NOTE: IN CASE OF ANY CONFLICT BETWEEN THESE OFFICIAL RULES AND THE SPONSOR’S ONLINE PRIVACY POLICY, THE TERMS OF THESE OFFICIAL RULES SHALL CONTROL.

 

Release and Limitations of Liability:  By participating in this Sweepstakes, entrants agree that the Sweepstakes Entities are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries.  No more than the stated number of prizes will be awarded.

Publicity:  EXCEPT WHERE PROHIBITED BY LAW, WINNERS GRANT TO THE SPONSOR, ADMINISTRATOR, WARNER BROS., AND ALL OF THEIR RESPECTIVE PARTNERS, PARENT COMPANIES, DIVISIONS, SUBSIDIARIES, AFFILIATES, TRUSTEES, FRANCHISEES, LICENSEES, DISTRIBUTORS, PRIZE PROVIDERS, ADVERTISING, PROMOTION AND PUBLIC RELATIONS AGENCIES (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR) AND THOSE ACTING PURSUANT TO SPONSOR AND ADMINISTRATOR’S AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, EACH WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.  ENTRANTS AGREE THAT SPONSOR SHALL OWN THE ENTRIES, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED, AND THAT SPONSOR AND ITS DESIGNEES SHALL HAVE THE PERPETUAL, WORLDWIDE RIGHT TO EDIT, PUBLISH, AND USE THE ENTRIES IN ANY WAY AND IN ANY MEDIA FOR TRADE, ADVERTISING, PROMOTIONAL, AND/OR OTHER PURPOSES AS SPONSOR AND/OR ITS DESIGNEES MAY DETERMINE WITHOUT FURTHER CONSIDERATION TO ENTRANTS OR ANY THIRD PARTY. 

DISPUTES/CHOICE OF LAW:  Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Los Angeles County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased This content is governed by the laws of the State of California in the United States of America, without respect to conflict of law doctrines.
